Bilski at the Supreme Court: A Panel on Patentable Subject Matter
The Intellectual Property Institute and the Intellectual Property Law Association sponsored a program on the Bilski case, an important patent case that was decided by the US Supreme Court in June. The panel presentation took place on Tuesday, April 6.
The case involved a "business method patent" covering hedge fund processes, and raised issues concerning the scope of inventions that should be eligible for patent protection, a topic the Supreme Court had not addressed for over 25 years.
The distinguished panel included Denise DeFranco, a partner at Finnegan who represented Bilski at the Supreme Court; Joe Mueller, a partner at WilmerHale who will give the government position; and Professor Eileen Herlihy, who teaches Patent Law and Current Issues in Patent Law at New England Law.
